By booking a Vatsoo cleanout, you agree to the terms set out below. These terms are written in plain language, but they are legally binding. Please read them carefully before completing your booking.
1. What Vatsoo Does
Vatsoo provides a residential garage cleanout service. You pay a fixed flat fee, our team arrives on the date you have booked, and the cleanout is completed within 24 hours of the time work begins. The entire contents of the garage will be removed.
After items have been removed from your property, the disposal, resale, donation, or recycling of those items is at the sole discretion of Project Eminent (Pty) Ltd, on a voetstoots basis.
Garage Sizes
The flat-fee pricing is based on the following standard dimensions:
- Single garage: up to 3.5m × 6m (21m²)
- Double garage: up to 7m × 6m (42m²)
If your garage exceeds these dimensions, a custom quotation will apply. Dimensions will be verified on arrival, and the rate will be adjusted accordingly if the actual size differs from what was booked.
Broom-Clean Standard
On completion, the garage will be left broom-clean. This means the floor will be swept, visible cobwebs will be cleared, and the space will be left in a usable condition.
What We Do Not Remove
Vatsoo removes the contents of the garage, not the structure itself. Walls, ceilings, roofs, garage doors, garage door motors, flooring, fixed electrical wiring, and plumbing are excluded from the service unless expressly agreed in writing.
What Happens to Your Items
Once items have been removed, Project Eminent (Pty) Ltd may, at its sole discretion:
- Resell any item with market value;
- Recycle metals, plastics, paper, and glass;
- Donate usable items to charitable organisations;
- Dispose of non-salvageable waste at licensed facilities.
You will not have a say in the destination of any specific item.
2. Transfer of Ownership
Once items have been removed from your property by our team, ownership of all such items transfers fully and permanently to Project Eminent (Pty) Ltd, on a voetstoots basis. You waive all rights, title, and interest in those goods from that point onwards.
Project Eminent (Pty) Ltd is under no obligation to disclose what is done with any specific item, and may sell, donate, repurpose, recycle, or dispose of any item at its sole discretion.
Once items have been loaded onto our vehicle, the transfer of ownership is final and irrevocable.
3. No Claim-Back
Once the cleanout is complete and items have left your premises, you may not claim back any item, for any reason, under any circumstances.
Please remove any items you wish to retain before our team arrives. Everything present in the garage when the crew begins work will be removed. No selective retention or cherry-picking is permitted once the cleanout has begun.
A final walkthrough will be conducted with you to confirm the scope before loading commences. Once you have given approval to proceed, the agreement is final.
4. Ownership Warranties
By booking a Vatsoo cleanout, you warrant that:
- You are the lawful owner of all items in the garage, or you have the legal authority to dispose of them;
- No items are stolen, subject to a lien, or claimed by any third party;
- You have the right to transfer ownership to us;
- You are not disposing of items that form part of a divorce settlement, deceased estate, or active legal dispute, unless you have proper legal authority to do so.
If any of these warranties are found to be incorrect, you will be liable for any resulting losses, legal costs, or fines incurred by Project Eminent (Pty) Ltd.
5. Indemnity
You indemnify Project Eminent (Pty) Ltd, its directors, employees, and contractors against any and all claims, losses, damages, and expenses (including legal costs) arising from:
- Third parties claiming ownership of items removed from your property;
- Hazardous materials or dangerous items that you failed to disclose;
- Any misrepresentation by you of ownership or authority to dispose of items;
- Any breach of these Terms and Conditions by you.
6. Limitation of Liability
To the maximum extent permitted by South African law (including the Consumer Protection Act 68 of 2008):
- The total liability of Project Eminent (Pty) Ltd for any claim arising from a cleanout shall not exceed the flat fee paid for that cleanout;
- Project Eminent (Pty) Ltd shall not be liable for any indirect, consequential, or special damages;
- Project Eminent (Pty) Ltd shall not be liable for the loss of any item that you intended to retain but left in the garage at the time of the cleanout.
South African law does not permit the exclusion of liability for death or personal injury caused by gross negligence, or for fraud. Such liability is not excluded.
7. Hazardous and Restricted Items
You must disclose any hazardous or restricted items present in the garage before work begins. This includes, without limitation: chemicals, oils, pesticides, paint, solvents, asbestos, fuel, gas cylinders, firearms and ammunition, motor vehicle batteries, and medical waste.
Additional fees may apply. If any such items are identified during the cleanout, their removal and safe disposal may require specialist handling outside the scope of the standard flat fee. In that case, you will be offered two options:
- Leave the items in the garage — they will not be removed and will remain your responsibility;
- Authorise removal at an additional fee — a quotation will be provided on-site, and removal will only proceed once you have agreed to the additional fee in writing.
Failure to disclose hazardous or restricted items before the cleanout does not exempt you from any additional fees incurred. You accept full responsibility for any undisclosed items and indemnify Project Eminent (Pty) Ltd against any costs, fines, or claims arising from them.
8. Payment
All prices are inclusive of VAT (15%). A 50% holding deposit is required to confirm your booking. The full balance must be settled before the crew commences loading.
The deposit is non-refundable. Once the booking is confirmed, the 50% deposit is forfeited in the event of cancellation. Rescheduling may be possible if you notify us in advance, but the deposit will be retained in any event. Once the cleanout has commenced, no refund will be issued on any portion of the payment.
9. Booking and Access
Our team will arrive on the date confirmed at the time of booking. From the moment work begins, the cleanout will be completed within 24 hours.
You, or an authorised representative aged 18 years or older, must be present for the duration of the cleanout.
If, on arrival, our team is unable to access the property, they will wait for a period of 30 minutes. If access is not granted within that time, our team will leave the site and a rebooking fee will apply.
10. Environmental Compliance
Project Eminent (Pty) Ltd is committed to responsible disposal practices. All non-salvageable waste is transported to licensed municipal landfills or waste management facilities. Recyclable materials are separated wherever practicable, and illegal dumping on public or private land is strictly prohibited.
Where hazardous materials are identified, they are handled in accordance with applicable environmental, health, and safety regulations, including the use of specialised disposal channels where required by law.
11. Second-Hand Goods Act Compliance
Project Eminent (Pty) Ltd, trading as Vatsoo, is a registered second-hand goods dealer in terms of the Second-Hand Goods Act 6 of 2009. We are required to record your full name, identity number, and address, retain a copy of your identity document, and maintain a register of goods acquired. This information may be made available to the South African Police Service (SAPS) on request.
12. Privacy (POPIA)
Personal information is collected and processed in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). We collect your name, contact details, identity number, and address for the purposes of service delivery and legal compliance. Your personal information will not be sold or shared with third parties except as required by law.
13. Electronic Transactions
In accordance with the Electronic Communications and Transactions Act 25 of 2002, by completing a booking online you enter into a binding electronic transaction with Project Eminent (Pty) Ltd.
14. General
These Terms and Conditions are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms shall be subject to the jurisdiction of the courts of Pretoria.
If any clause of these Terms is found to be invalid or unenforceable, the remaining clauses shall remain in full force and effect.
Nothing in these Terms is intended to limit any right you may have under the Consumer Protection Act 68 of 2008 that cannot be excluded by agreement.
